What this stage means

A California nonjudicial foreclosure sale is generally deemed final when the trustee's deed is delivered, and a rebuttable presumption of validity attaches once it is recorded.

If the deed has not yet been delivered or recorded, a narrow window may remain, particularly where there was a procedural defect or a servicing error.

If the sale did occur, the purchaser must still follow lawful eviction procedure. Occupants generally receive a written notice to quit before any unlawful detainer action, and tenants may have additional protections.

Surplus proceeds may exist if the property sold for more than the total debt and costs. Claims are handled through the trustee and, in some cases, the court.

Uncertainty is itself a risk. Many borrowers discover the sale was postponed or never occurred, and act on false assumptions in both directions.
